    Important Update: Farris is pleased to announce that a settlement has been reached with Navistar Canada ULC, Navistar Inc., Navistar International Corporation and Harbour International Trucks Ltd. (the “Defendants”). The Defendants have agreed to a settlement valued at $14,500,000. The Supreme Court of British Columbia approved the settlement and the payment of Class Counsels’ legal fees and other related costs on November 30, 2023. Class Members are all persons or entities in Canada, excluding Québec, who, on or before February 24, 2022, purchased or leased for more than 30 days, a 2011-2014 model year Navistar vehicle equipped with a MaxxForce 11-, 13- or 15- litre engine.     Farris Partner Ludmila B. Herbst, K.C., presented at the “Legal Case Review” session held by the B.C. chapter of the Canadian Property Tax Association on May 16, 2024. Ludmila was part of a panel of industry lawyers discussing notable recent cases that have come before the B.C. courts and the Property Assessment Appeal Board. Ludmila is a corporate-commercial litigator whose wide-ranging practice includes acting in property tax cases for developers and other taxpayers.     Farris is thrilled to congratulate our returning Articling Student, Vanessa Locke, on being awarded the Law Society of British Columbia’s Gold Medal for Thompson Rivers University Faculty of Law. The medal is awarded annually to the graduating law student from each of TRU, the University of Victoria and the University of British Columbia faculties of law who achieved the highest cumulative grade point average over their respective three-year program. Vanessa attended TRU Law after completing her Bachelor of Arts at the University of Victoria. She summered with Farris in 2023 and will return to complete her articles this summer following PLTC. These awards honour the best litigation firms and best individual litigators in Canada.     On May 7, 2024, Farris Partner Mike Wagner, who chairs the Canadian Bar Association, BC Branch subsection on Air & Space Law, hosted a discussion with Allan Burnside, Senior Director of the Canadian Transportation Agency, for an update on Canada’s Air Passenger Protection Regulations. The session covered the continuing evolution of the APPRs, the ongoing challenges of balancing the interests of airlines and those of travelers, and touched on the pending appeal in the Supreme Court of Canada, by the International Air Transport Association, challenging the current APPR regime. Members of the Farris Transportation practice group attended, together with in-house counsel to one of our airline clients, and other interested lawyers. The session was lively and informative. CTA Director Burnside has agreed to participate in a second discussion later this year, once the further changes to the APPRs have been announced.
